Bengkulu, mimbarline.com – Badan Pengawas Pemilihan Umum (Bawaslu) Provinsi Bengkulu menyatakan laporan dugaan money politics atau politik uang yang dilaporkan oleh tim pasangan calon (paslon) Helmi-Mian terhadap paslon nomor urut 2 dalam Pilgub Bengkulu tidak memenuhi unsur. Keputusan tersebut setelah melalui serangkaian kajian dan pembahasan intensif bersama tim penegakan hukum terpadu (Gakkumdu), yang melibatkan unsur dari Polda Bengkulu, Kejaksaan, dan Bawaslu sendiri.
Hal itu disampaikan Anggota Bawaslu Provinsi Bengkulu, Eko Sugianto, menyampaikan bahwa laporan dugaan money politics ini telah menjadi perhatian dan dipelajari secara mendalam. Namun, berdasarkan hasil pembahasan dan kajian bersama Gakkumdu, laporan tersebut dinyatakan tidak memenuhi unsur-unsur yang diatur dalam ketentuan hukum terkait.
Menurut Eko, ketentuan yang dimaksud adalah pasal 187 A dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, yang mengatur tindak pidana politik uang. Pasal ini menyatakan bahwa setiap bentuk pemberian uang atau hadiah dengan maksud memengaruhi pilihan pemilih adalah tindakan yang dilarang. Namun, dalam kasus ini, Bawaslu menyatakan bahwa dugaan tersebut tidak memenuhi kriteria yang diatur dalam pasal tersebut sehingga tidak dapat diteruskan sebagai tindak pidana.
Laporan ini bermula dari sebuah video yang menunjukkan paslon nomor urut 2 diduga membagikan uang sebesar Rp20.000 kepada masyarakat. Namun, Eko menegaskan bahwa berdasarkan kajian mendalam yang dilakukan, bukti dalam video tersebut tidak mencukupi untuk menunjukkan adanya niat atau tindakan yang melanggar hukum dalam konteks politik uang.
”Kami telah melakukan kajian dan pembahasan bersama Gakkumdu terkait video yang dimaksud. Setelah melakukan kajian lebih lanjut, dapat disimpulkan bahwa video tersebut tidak memenuhi unsur-unsur yang diatur dalam pasal 187 A Undang-Undang Pemilu. Oleh karena itu, laporan tersebut tidak dapat diteruskan,” ujar Eko, saat dikonfirmasi media ini, Senin (28/10/2024).
Dengan keputusan ini, Bawaslu berharap semua pihak, terutama tim sukses dari masing-masing calon, dapat menerima keputusan ini dan tetap menjaga kondusivitas suasana pilkada di Bengkulu. Bawaslu juga berkomitmen untuk terus melakukan pengawasan ketat agar setiap tahapan pilkada berjalan dengan bersih dan transparan tanpa adanya kecurangan.
Keputusan ini diharapkan dapat memberikan kejelasan dan kepastian hukum terkait proses Pilkada di Bengkulu dan mencegah isu-isu yang dapat merusak integritas proses demokrasi. (RLSDani/MCPK)
